NOTICE TO TAXPAYERS AND ALL OTHER PERSONS AFFECTED OF (1) ADOPTION AND CONTENT OF DECLARATORY RESOLUTION OF CITY OF BOONVILLE REDEVELOPMENT COMMISSION AMENDING DECLARATORY RESOLUTION AND ECONOMIC DEVELOPMENT PLAN FOR CITY OF BOONVILLE ECONOMIC DEVELOPMENT AREA #1, (2) PUBLIC HEARING ON SAID DECLARATORY RESOLUTION, AND (3) PUBLIC HEARING CONCERNING A PROPOSED LEASE BETWEEN THE CITY OF BOONVILLE REDEVELOPMENT AUTHORITY AND THE CITY OF BOONVILLE REDEVELOPMENT COMMISSION.
Taxpayers of the City of Boonville Redevelopment District (“District”) and all other persons affected hereby are notified that the City of Boonville Redevelopment Commission (“Commission”), at a meeting held on October 4, 2022, adopted its Resolution No. 2022-1 (the “Declaratory Resolution”) amending the declaratory resolution and economic development plan (the “Original Declaratory Resolution and Plan”) related to the City of Boonville Economic Development Area #1 (the “Area”) to (i) include as additional projects, the planning, designing, and construction of various local public improvements including INDOT revitalization project, street improvements, City Lake improvements, signage, park improvements, sidewalks, public safety vehicles and equipment, bridge repairs, pool improvements, security improvements, building improvements, water/sewer improvements, lighting and other related improvements (collectively, the “New Projects”) and (ii) increase the cost estimates for the projects to be undertaken pursuant to the Original Declaratory Resolution and Plan by $3,985,00 to account for the New Projects.
The Commission will use property taxes levied and collected in the District in accordance with Indiana Code 36-7-14 and Indiana Code 36-7-25 to finance the New Projects. As more particularly described in this notice, the New Projects will be financed through a lease agreement between the Commission and the City of Boonville Redevelopment Authority (the “Authority”).
The Declaratory Resolution, the Original Declaratory Resolution and the Plan, as amended by the Declaratory Resolution, and supporting data including maps and plats describing the Area, have been prepared and can be inspected at the office of the Secretary of the Commission, Boonville City Hall, 135 South Second Street, Boonville, Indiana (the “City Hall”).
Hearing on Declaratory Resolution
Notice is further given that the Commission on October 24, 2022 at the hour of 4:00 p.m., local time, in the City Hall, will receive and hear remonstrances from persons interested in or affected by the proceedings pertaining to the proposed New Projects and will determine the public utility and benefit of the Original Declaratory Resolution and Plan as amended by the Declaratory Resolution. At the time fixed for hearing or at any time prior thereto any person interested in the proceedings may file a written remonstrance at the office of the Secretary of the Commission at the City Hall, if filed prior to the time fixed for the hearing or with the Secretary of the Commission if filed at the hearing. At such hearing, which may be adjourned from time to time, the Commission will hear all persons interested in the proceedings and all remonstrances that have been filed. After considering this evidence, the Commission will take final action by either confirming, modifying and confirming, or rescinding the Declaratory Resolution.
Hearing on Lease
Interested persons are hereby further notified that on October 24, 2022, the Commission will hold a public hearing upon a proposed lease (the “Lease”) to be entered into between the Authority, as lessor, and the Commission, as lessee, of certain real estate consisting of certain streets in the City, in connection with the financing of the New Projects. Lease rentals under the Lease will be payable from a special benefits tax levied under Indiana Code 36-7-14-27. The public hearing will be held at 4:00 p.m., local time, in the City Hall, immediately following the aforementioned hearing on the Declaratory Resolution. All interested parties will be provided the opportunity to be heard at the hearing. After the public hearing, which may be adjourned from time to time, the Commission may adopt a resolution authorizing the execution of the proposed Lease on behalf of the City, if it finds that the service to be provided throughout the term of the proposed Lease will serve the public purposes of the City and it is in the best of interests of the City’s residents and that the Lease rental provided for is fair and reasonable. The proposed Lease is open to public inspection in the City Hall.
